was just another clear day in California when a 50-year-old dataentry clerk walked across the street via a crosswalk. Suddenly, she was struck by a tour bus. The impact hurled her to the ground, fractured her skull and caused permanent brain injury. In those brief moments, the woman’s life was forever altered. Not only could she no longer work, but she would require 24-hour care for the rest of her life.
The bus company offered $7.7 million during trial, but the amount was inadequate compensation for her permanent injuries, according to Randall H. Scarlett , founder of the Scarlett Law Group , which represented the pedestrian. After a vigorous three-week trial, the jury awarded $22.8 million in damages. Justice was served.
The case demonstrates the Scarlett Law Group's dedication to clients who've sustained traumatic brain injuries. "I want nothing more than to improve my client's quality of life," says Scarlett, who has been named to the Northern California Super Lawyers® list.
The Scarlett Law Group concentrates its practice on the vigorous and ethical representation of catastrophically injured clients as well as their survivors. The firm continues to focus on the representation of those sustaining traumatic brain injury.
PROOF IN NUMBERS: Scarlett has obtained several multimillion-dollar verdicts and/or settlements for brain-injury victims in California and Nevada. In 1995, a 7-year-old brain-injured client received $26 million after her doctor failed to diagnose H-Flu meningitis.
The San Francisco Trial Lawyers Association nominated Scarlett as Trial Lawyer of the Year for a $1.2 million verdict for the victim of a low-impact automobile collision, during which the plaintiff's vehicle only suffered $500 in damages.
Determined to assist clients on all fronts, Scarlett serves as a board member of the Brain Injury Association of California, and he's served on the board of the Marin Brain Injury Network.
A VARIED PRACTICE: The Scarlett Law Group also represents clients impacted by the Exxon Valdez oil spill, as well as clients who have sustained business and property loss.
Scarlett served as lead counsel for direct-action plaintiffs in the human rights litigation against the estate of Ferdinand E. Marcos, the former president of the Philippines. The judgment was a recordsetting $1.2 billion.
Other cases involve aviation and vehicle accidents, spinal cord injuries, professional negligence, civil rights and construction defects.
HIGHLY COMMITTED: The Scarlett Law Group, which has received Martindale-Hubbell®’s highest AV rating, is listed in The Bar Register of Preeminent Lawyers.
In part, credit the firm’s high ranking with the personal attention it gives each client. The firm has purposefully stayed small to maintain that high service level.
"We are absolutely committed to our clients," Scarlett concludes. "We want to make a difference for both them and for the community in which we live."
